Taoyuan, August 31, 2007 - Nanya Technology Corporation (TAIEX: 2408), a DRAM manufacturer based in Taiwan, clarified today that its wholly owned subsidiary in Japan, Nanya Technology Corporation Japan, was ruled unfavorably by the Tokyo Distrit Court in a litigation case against Fujitsu Limited. The formal ruling from Tokyo District Court regarding the litigation has not been received by Nanya. The Court opinion will be reviewed to determine its options regarding an appeal after receiving the judgment. The impact of this ruling is estimated to be minimal to both Nanya's operations and performance.
In addition to the Tokyo District Court, Nanya is also involved in a litigation case against Fujitsu in the United States. The United States Patent and Trademark Office has already granted Nanya’s reexamination applications on 3 of the 5 Fujitsu’s patents asserted against Nanya. Nanya expects the remaining two patents being asserted by Fujitsu, including the US counterpart to the Fujitsu patent being asserted in Japan, will also be granted for reexamination by USPTO in the near future. This introduces uncertainty into Fujitsu patents' validity as well as enforceability.
Nanya respects the intellectual property rights of other companies, and also expects other companies to respect Nanya’s intellectual property right. In this case, Nanya believes it does not infringe any of Fujitsu's patents and will further continue its legal procedure to protect its rights.
